COMMERCIAL LITIGATION
Whenever
Litigation avoidance strategies such as representation
before administrative authorities, tribunals and mediators
have been exhausted and the dispute remains unresolved,
we put the legal machinery in action. The Practice and
procedures of the Courts in the Commonwealth of Dominica
and other Caribbean countries generally follows the
principles of law as applied in the English Courts.
Also, in that connection, it must be noted, that cases
under the Canada Companies Act are persuasive authorities
and are followed and applied by the Courts of Dominica
and the other Caribbean Countries since the Dominican
Companies Act and that of the other countries are modeled
on the Canadian Companies' Act. Notwithstanding that,
Case law and Law texts from other Commonwealth Jurisdictions
are also considered. Accordingly, all the usual pre-emptive
remedies like the Mareva injunction (freezing a defendant's
assets pending disposition of an action); Anton Piller
Orders (Permitting the search for and seizure of property
and records in fear of them being removed or destroyed)
are available; the former in particular being commonly
employed.
The
High Court sits all year long and the Sessions are presided
over by a puisne Judge. The Court of Appeal with a panel
of three appellate judges sits annually throughout the
Eastern Caribbean Countries. However, matters which
require urgent attention are dealt with speedily and
expeditiously; the Court not having to wait for the
prescribed sessions.
